The Futian District People's Court on April 26 released a white paper on the judicial protection of intellectual property rights related to foreign affairs and Hong Kong, Macao and Taiwan.
The white paper, covering the period of 2018-2022, has comprehensively showcased the achievements of the court in deepening the reform of the trial mechanism and improving the level of judicial protection of intellectual property rights related to foreign affairs.
According to the white paper, the Futian court accepted a total of 906 civil intellectual property cases involving foreign affairs and Hong Kong, Macao and Taiwan from 2018 to 2022 and concluded 857 cases, accounting for 14% of the total number of ordinary intellectual property cases settled during the same period by the court.
The white paper shows that the Futian court has made efforts to improve efficiency and focus on solving the problems of "long cycle," "high cost" and "difficult to gather evidences" in foreign-related intellectual property litigation.
The court has continuously provided fair, just and efficient judicial services and guarantees to domestic and foreign investors and striven to create a market-oriented, legal and international business environment.
In 2022, the average trial cycle of foreign-related intellectual property civil cases by the Futian court decreased 23.7% year on year, according to the white paper.
The court also released 10 typical cases involving intellectual property rights protection. These cases are focused on copyright, trademark rights, unfair competition, covering foreign copyright protection, the application of punitive damages in the field of trademark infringement, the protection of time-honored brands' trademark rights and other fields.
The court simultaneously made public the judgment documents to provide useful reference for intellectual property rights protection. It also provides fresh intellectual property law popularization materials for the public.
